Vonage Australia Pty Ltd (“Vonage”) is sponsoring a virtual webinar event entitled, APAC Convo Virtual 2021”, which will be held online on Thursday 11 November 2021 (“Event”). There will be a chance to win Prizes as defined below for participation in the Event (“Giveaway”). Instructions on how to enter and participate in the Event to win Prizes during the Giveaway are listed here. 

NO PURCHASE NECESSARY TO ENTER OR TO WIN.  A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. ALL LOCAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

Eligibility Requirements. Subject to conditions below, the Event is open to adults who are  age 18 years or older at the time of entry and are registered for the Event. Employees and non-employee workers of Vonage, Sponsors, their respective affiliates, advertising and promotional agencies, the immediate family members of all such employees and all others with whom they are domiciled are not eligible to win Prizes or otherwise participate in this Event. 

Prizes and Approximate Retail Values (“ARV”). Vonage will give away a minimum of three (3) and up to a maximum of seven (7) gift cards valued at $300 each (total ARV from $900 up to $2100) during the event Giveaway (the “Prizes”).  

How To Enter. To enter into the Giveaway during for the Event, the participant must: (1) be registered to attend the Event, (2) sign into the registration link  provided to the attendee on the day of the Event; and (3) stay for the entire Event from beginning to end starting at 1:00pm - 4:00pm SGT | 10:30am - 1:30pm IST | 4:00pm - 7:00pm AEDT (“Promotional Period”).

Participation in the Giveaway: There will be three (3) chances to win Prizes throughout the Event. Listed below are the ways to participate in a chance to win one of the Prizes during the Giveaway.

• Early Bird Giveaway - a predetermined registration number has been randomly chosen by Vonage prior to this Event. Upon registering for the Event, the person whose registration number coincides with the number randomly chosen by Vonage will automatically win one (1) Prize.

• Lucky Draw - during the Promotional Period, there will be (2) polls conducted; a Lucky Draw#1 and Lucky Draw#2. Each attendee who participates in a question and answer poll on the main stage at the end of a scheduled speaking engagement will be eligible to win. Two predetermined participation numbers will have been randomly chosen by Vonage prior to the Event. Upon participating in the poll, the persons whose participation number coincides with one of the two numbers randomly chosen by Vonage will each automatically win one (1) $150 gift card Prize. 

• Kahoot! Quiz - during the last segment of the Promotional Period, Vonage will quiz attendees on the various topics that have been discussed throughout the Event. The quizzes are hosted in various virtual chat rooms as will be announced during the Promotional Period. Vonage will randomly select at least one (1) participant who answered all the questions correctly as the winner of a Prize. A minimum of at least one (1) Prize will be awarded to the randomly selected winner. Up to three (3) additional Prizes may potentially be awarded to randomly selected winners based upon availability and at Vonage's sole discretion.

Limit one (1) Prize awarded per person during the Event and Promotional Period. Once all Prizes for the Event have been given away, the Promotional Period will end. The Prize is nontransferable and non-assignable. No substitutions or cash equivalents will be allowed. Prizes are subject to availability and Vonage may substitute a Prize or Prize component of equal or greater value.   

Notification of the Winner. Except for the Early Bird Giveaway Prize, which will be pre-selected at random by Vonage, the attendees who participated in the Giveaway and have won a Prize  will be determined and identified from among all participants by Vonage based on: (a) their participation, (b) the accuracy in answering the questions presented; and (c) the placement order within which the question was answered (1st, 2nd, 3rd, etc.) amongst all the participants during the Promotional Period (“Winner”). However, the participants must be present during the entire Promotional Period in order to be eligible to win a Prize. Vonage will notify the Winner(s) via email within two (2) weeks after the Promotional Period. The selected Winner must respond to Vonage’s notification within 24 hours of notification. If the selected Winner does not reply to Vonage within this time frame, the selected Winner may be disqualified and Vonages may select the next runner up as a substitute Winner from among all remaining eligible participants.

Winners are solely responsible for any and all applicable fees or taxes for the Prize value. Prizes that are won but not claimed by the winner in accordance with these Official Rules will not be awarded and will remain the property of Vonages.

Except where prohibited, acceptance of any Prize constitutes the Winner’s irrevocable consent to the publication or other use by Vonages and their licensees of his or her name, biographical information and likeness in any media, including the Internet, for any commercial, publicity or promotional purpose, without limitation, review or approval, or additional compensation. 

Odds. The chances of winning depend on the number of sponsors who host a sponsored speech and the total number of eligible attendees who participate in and qualify for the Prize. Vonage reserves the right to: suspend, cancel, or modify this promotion at any time in its discretion. 

Release. By participating in the Giveaway, each participant agrees to fully release, forever discharge and hold harmless sponsor, Vonage Holdings Corp., its respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers and each such company’s officers, directors, employees, agents, representatives, and successors and assigns (collectively, the “released parties”) from and against any claims, costs, liabilities, losses, injuries, and damages arising out of the Giveaway, including, but not limited to, any claims for personal injury, death, or damage to or loss of property, loss of enjoyment, or any other harm whatsoever arising out of: (1) participation in the Giveaway; (2) the quality, receipt, possession, use, or misuse of any prize; or (3) any travel or activity that is related to the Giveaway or any prize.

The released parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by participants, printing or production errors, or by any of the equipment or programming associated with or employed in the Giveaway; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines, the internet or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Giveaway; (4) technical or human error which may occur in the administration of the Giveaway, the processing of entries, or the notification of any provisional winner; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from an participant’s participation in the Giveaway or receipt or use or misuse of any prize.

Limitations of Liability. By participating in the Giveaway, participants acknowledge and agree that everything regarding this Giveaway, including the prize, are provided “as is” and that the released parties make no representations or warranties of any kind, express or implied, about the prize and the released parties hereby disclaim all such warranties, including, but not limited to, any implied warranties of merchantability or fitness for a particular purpose. (because some states do not allow the exclusion or limitation of certain implied warranties, the above limitation may not apply to you. In such states, the liability of the released parties is limited to the fullest extent permitted by such state law.)

Privacy. All personal information submitted by you as part of this Giveaway will be treated in accordance with the Vonage Privacy Policy except as otherwise described in these Terms & Conditions and/or any promotional materials. By participating in this Giveaway, you acknowledge and agree that all information and material, including any personal information provided by your entry materials, affidavits, and releases, will be collected, used and disclosed by the Vonage and its authorized agents, representative, and other third parties involved in the execution, administration, or hosting of this Giveaway, for the purposes of administering the Giveaway and prize fulfillment and may be further publicized as described above.

Disputes. As a condition of entering, participant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, this Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Georgia, and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering any Giveaway, but in no event attorneys’ fees. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms & Conditions, or the rights and obligations of the participant and Vonage in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules.

Vonage. The sponsor of this giveaway is Vonage Australia Pty Ltd, which is located at Level 12680, George Street, Sydney, NSW 2000, Australia.
